Maxfeld.legal represented an internationally active group, following a corporate acquisition, in more than 20 employment proceedings. The claimants each asserted that their employment relationships had passed to the acquirer by way of a transfer of business under section 613a of the German Civil Code (BGB).
Maxfeld.legal argued that there had been no transfer of the business as a whole, but at most a partial transfer of business. The claims were successfully defended in all of the proceedings.
